Retail Site Location and Analysis

The identification and evaluation of store locations and negotiation of the lease agreement are handled by our in-house staff of real estate professionals. Choosing your location and securing the best possible lease terms are among the most critical decisions you will make. We have established relationships with Leasing Agents, Landlords and the largest shopping center management companies in the country. Because we have worked with them many times, these relationships enable us to secure preferential terms and quick results.

Our in house Real Estate staff of over 25 team members includes Commercial Brokers, Licensed Real Estate Sales professionals and a paralegal - to make sure that every lease agreement is thoroughly reviewed and the language adjusted in ways most favorable to our client. Our wholly-owned Real Estate company has licensed brokers in all 50 states to ensure that every lease negotiated by our Real Estate department complies with every state’s specific requirements. Often, we will negotiate on several locations, because the final terms of an agreement may make one location ultimately more attractive than another in terms of rent and the potential for business.

We do not use, nor allow, independent brokers to make critical site and lease decisions because they are not knowledgeable in our business. Too often, independent brokers are focused on only showing their listings or earning commissions, while our staff is only interested in placing our clients in the most viable location and at the most competitive lease rates. We do not work for landlords; our only client is YOU.

Lease Negotiation

Once the proper location has been identified, the Leasing Manager assigned to the project will negotiate the terms of the lease for our client directly with the landlord or agent. We typically negotiate a minimum of 17 key provisions in every lease agreement. In addition to the obvious (rent, free rent, free time for fixturization, tenant improvement allowances, term of the lease, and more) these provisions include confirming that the restrooms are ADA compliant, dark clauses (which provides you protection in the event the anchor tenant moves out of the center) and relocation clauses (this protects you against a landlord moving you to a different location in the center without your consent), and a protected use clause - to name but a few. A properly negotiated and reviewed lease can potentially save a tenant tens of thousands of dollars; an improperly negotiated lease can cost a tenant just as much! Our Leasing Managers negotiate over 200 leases annually and are skilled at reviewing, evaluating, and negotiating retail leases. And of course, our Director of Real Estate reviews each lease to make sure that every lease is as favorable as possible to our clients. Our clients are in constant communication with their Leasing Manager throughout the lease process, assuring that they are in total agreement with every term in their lease. Once the lease has been thoroughly reviewed in its final form by our Leasing Manager, Director of Real Estate and the client, and all questions have been asked and answered to the client’s satisfaction, it is ready for signature!
